ROADSIDE ASSISTANCE GUARANTEE
Terms and Conditions
WHAT ARE THESE TERMS AND WHO IS INVOLVED?
These are the terms and conditions for the Roadside Assistance Guarantee. The Roadside Assistance Guarantee is provided by the Selling Authorised Norton Dealer. The roadside assistance services are
organised and delivered by the appointed assistance provider identified below. Guarantee claims are administered by the Guarantee Administrator, Invictus Protect Limited.
The Roadside Assistance Guarantee is included with the vehicle. No separate purchase is required.
The Roadside Assistance Guarantee ends in accordance with the provisions of §6(2).
HOW TO REQUEST ASSISTANCE
In the event of a breakdown, claims under the Roadside Assistance Guarantee must be reported exclusively and directly to the appointed assistance provider, before undertaking any independent initiative:
Assistance Provider: Invictus Protect Limited, Lower Ground Floor, Martland Mill, Burscough, L40 0SD
24-Hour Assistance Line: 01945 759252
Availability: The service hotline is staffed 24 hours a day, 7 days a week.
Information required when calling: Name; vehicle make, model and registration; location of the vehicle; nature of the breakdown; date of commencement of the Guarantee.
Failure to contact the assistance provider in advance, and to coordinate the services to be provided, may result in forfeiture of the right to assistance services.
The Guarantee covers the restoration of mobility in accordance with §3 following a breakdown.
A breakdown is defined as the sudden and unexpected failure of a component which is covered by the Norton or Norton dealer bike warranty in force at the relevant time that results in the vehicle coming to a standstill. A breakdown also occurs if the vehicle no longer being technically roadworthy.
The Guarantee applies to vehicles purchased in the United Kingdom or vehicles that have undergone maintenance and/or inspection in the United Kingdom. The vehicle must meet the following requirements:
- registration as a motorcycle, passenger car (PC) or light commercial vehicle (LCV);
- for motorcycles, an engine capacity of more than 50cc;
- for passenger cars and light commercial vehicles, a maximum permissible gross weight of no more than 3.5 tonnes.
Only the policyholder is entitled to exercise the rights under the Guarantee. All provisions made for the policyholder apply mutatis mutandis to authorised drivers and passengers.
If the vehicle is unable to continue its journey immediately due to a breakdown, the assistance provider will provide the following services:
- 1. Information call and telephone advice
The telephone service includes general mobility-related assistance by telephone, and technical support to restore the vehicle to a roadworthy condition and to prevent further damage. - 2. Breakdown assistance
Following a breakdown, the assistance provider ensures that the vehicle is restored to a roadworthy condition at the scene of the incident. If this is not possible, it arranges for the vehicle to be towed (including luggage and non-commercial cargo) to the nearest specialist workshop, or to the home workshop within a 60-mile radius. - 3. Hire car
If the vehicle is no longer roadworthy due to a breakdown and cannot be made roadworthy again within two hours, the customer may arrange a hire car themselves to continue the journey. The cost of the hire car will be reimbursed for the duration of the repair, up to a maximum of three days (cost limit: maximum £70 per day, including VAT). The customer should retain the hire car invoice as proof of the cost. - 4. Overnight accommodation in the event of vehicle breakdown
If, as an alternative to clauses 3 and 5, the passengers prefer to wait for the repair on site, hotel accommodation including breakfast for a maximum of 3 nights, up to a maximum of £75 including VAT per person per night, will be organised and paid for the policyholder and eligible passengers. All other costs are to be borne by the policyholder and the passengers. This service is provided if the distance between the location of the breakdown and the place of residence is 60 miles or more. - 5. Continuation of journey in the event of vehicle breakdown
As an alternative to the benefits under points 3 and 4, a standard-class train journey to the original destination — within the local area of cover — or back to the main place of residence will be organised and paid for the policyholder and eligible passengers. If the train journey exceeds 600 miles by rail, an economy-class flight may also be arranged and paid for as an alternative. In the event of a claim within the United Kingdom, costs are covered up to a maximum of £365 including VAT; in the event of a claim abroad, up to a maximum of £2,200 including VAT. - 6. Connection costs
The assistance provider organises onward travel for the policyholder and authorised passengers from the breakdown location to a hotel or the nearest railway station, coach station or airport. The costs incurred for this are limited to £100 including VAT. - 7. Collection of the repaired vehicle
If the repaired vehicle needs to be collected, the assistance provider will organise and pay for a standard-class train journey for one person to the location where the vehicle was repaired, covering costs up to a maximum of £500 including VAT. If the train journey exceeds 600 miles, an economy-class flight may also be chosen. This service is provided if the distance between the location of the damage and the place of residence is 60 miles or more. - 8. Return of the unrepaired vehicle
If the breakdown occurred abroad or at a distance of more than 300 miles from the place of residence within the same country, and the vehicle cannot be repaired within 5 working days of arrival at the dealer, repatriation of the unrepaired vehicle, the policyholder, passengers and luggage can be arranged. In this case, the services listed in points 3, 4 and 5 may be combined. The maximum cover, including transport costs, is £1,500 including VAT.
There is no cover if:
- the journey involves commercial transport (e.g. a taxi ride) or the use of a hired vehicle;
- the vehicle was driven by a person who was not authorised by the vehicle’s owner or who is not entitled to drive the vehicle under applicable law;
- drink-driving, the influence of psychotropic drugs or the consumption of narcotics and hallucinogens is established;
- the vehicle is involved in an accident, i.e. an event that suddenly affects the vehicle directly from an external source;
- the breakdown results from anything other than a vehicle fault covered by the Norton or Norton dealer bike warranty in force at the relevant time, e.g. from flat tyres, misfuelling or running out of fuel (except where such event is itself caused by a covered vehicle fault); the breakdown occurs off public roads or on roads not authorised for vehicles;
- the vehicle is stuck in sand or snow;
- parts of the vehicle or the fuel are rendered unusable due to the effects of cold weather;
- you are travelling to an area for which a travel warning from the Foreign, Commonwealth & Development Office was in place at the time of your departure due to hostilities (this also applies if the damage is not attributable to the hostilities);
- we would thereby be subject to sanctions, bans or restrictions based on United Nations resolutions or trade or economic sanctions, laws or regulations of the United Kingdom, the European Union or the United States of America.
The following are excluded from the scope of reimbursement:
- expenses that would have been incurred even under normal circumstances, e.g. fuel costs or toll charges;
- any costs or losses resulting directly or indirectly from the breakdown, e.g. loss of earnings, cancellation fees, cancellation of events (expired tickets);
- additional hotel costs, e.g. for meals and the minibar;
- repair costs and expenses for spare parts, as well as consumables and operating materials.
No cover is provided, regardless of contributing causes, for damage:
- caused by wilful or malicious acts, theft, unauthorised use, robbery and embezzlement;
- caused by the direct impact of animal damage (excluding animal bites), storm, hail, frost, oxidation/corrosion, lightning strike, earthquake or flooding;
- caused by acts of war of any kind, civil war or civil unrest (the assistance provider will assist, as far as possible, if you have travelled to a country where one of these events occurs unexpectedly, within 14 days of the event occurring; however, no cover is provided if you are actively involved in the event);
- as a result of strikes, lockouts, seizures or other acts of state authority, or as a result of nuclear energy;
- caused by the use of chemical, biological or biochemical substances or electromagnetic waves as weapons with a dangerous effect on the public, irrespective of any other contributing causes.
Breach of duty on the part of the policyholder
Furthermore, no cover is provided for damage arising from participation in racing-style driving events or from the associated practice runs; or to vehicles which have been used by the purchaser, at least temporarily, for the commercial carriage of passengers or goods (courier, express or parcel services) or which have been commercially let to a changing group of people. The exclusion of the damage referred to in this paragraph is subject to the condition that the occurrence of such damage is attributable to a negligent or intentional breach of obligation on the part of the Guarantee holder.
The Roadside Assistance Guarantee applies to the United Kingdom. If the vehicle is temporarily outside this territory, the Guarantee applies to Europe (in Russia and Turkey, only the European part), excluding the Azores. Please note the exceptions under “International Sanctions” in §4.
(1) The Roadside Assistance Guarantee is included with the vehicle and commences once the customer receives the vehicle. The cover runs for the agreed term of the Roadside Assistance Guarantee and ends upon expiry of that term, without the need for notice of termination. The start date is the date on which the customer receives the vehicle, as noted on the Guarantee agreement.
(2) The Guarantee expires in the event of the vehicle being destroyed or lost, or if the vehicle is re-registered abroad. Notwithstanding clause (1), the Roadside Assistance Guarantee ends automatically at the latest upon expiry of the thirteenth year following first registration.
In the event of a change of ownership during the Guarantee Period, this Guarantee will automatically transfer with the Motorcycle to the new owner for the remainder of the Guarantee Period, provided that the Motorcycle has been serviced and maintained in accordance with the terms of this Guarantee.
We may require the new owner to provide reasonable proof of ownership and, where requested, notify us of the change in ownership.
Any claim under this Guarantee must be brought within three years of the date on which the breakdown giving rise to the claim occurred. After that period, the claim becomes time-barred and can no longer be pursued.
The purchaser’s statutory claims for defects remain unaffected.
From the date of sale:
- timely performance of the maintenance work prescribed by the seller and the inspection work recommended by the manufacturer at the seller’s premises or at a qualified garage in accordance with the manufacturer’s specifications;
- compliance with the manufacturer’s instructions in the owner’s manual regarding the operation of the vehicle;
- immediate notification to the seller of any tampering with the odometer, other interference, a defect or a replacement.
- report the breakdown immediately by calling the assistance provider on 01945 759252, to coordinate with the assistance provider to determine whether and which services it will provide within the scope of the services specified in §3(1) to (8);
- avert the damage where possible and keep it to a minimum, and follow any instructions from the assistance provider;
- allow the assistance provider to carry out any reasonable investigation into the cause and extent of the damage and the scope of its liability for compensation;
- provide original receipts as proof of the amount of damage and, where applicable, inspection or maintenance invoices upon request.
The Guarantee Administrator appointed to handle roadside assistance claims under these Guarantee terms and conditions is Invictus Protect Limited. This appointment concerns the administration and handling of roadside assistance claims on behalf of the Guarantee Provider.
The appointed assistance provider is responsible for organising and delivering the roadside assistance services covered by the Guarantee. During the term of the Roadside Assistance Guarantee, the assistance provider organises the services in accordance with the applicable terms and conditions and settles the service provider’s costs directly as a rule. Should you, in exceptional cases and following consultation with the assistance provider, incur costs, these will be reimbursed promptly. For this, the original invoices for the services used (e.g. from towing companies) as well as a fully completed breakdown report are required.
In the event of an intentional breach of an obligation under §10(1) to (3) and §11(1) to (4), the assistance provider is released from its obligation to provide cover. In the event of a grossly negligent breach of such an obligation, the assistance provider is entitled to reduce its cover in proportion to the severity of the policyholder’s fault. The policyholder must prove the absence of gross negligence. However, except in cases of wilful fraud, the assistance provider remains obliged to provide cover provided the policyholder demonstrates that the breach of the obligation was not the cause of either the occurrence or the determination of the claim, nor of the determination or extent of the obligation to pay.
With regard to the listed benefits, claims for benefits shall only exist to the extent that no claim for compensation exists under a so-called manufacturer’s mobility guarantee or, subsidiarily, under existing insurance policies. That is to say, insofar as insurance cover for the same benefit also exists with an insurer or manufacturer, the other claim shall take precedence.
